EVIQ Terms of Service

By creating an account on EVIQ, scanning a QR code at one of our charging stations, or downloading and using the EVIQ Driver app, you agree to these Terms of Service ("Terms"). EVIQ is operated by NISR AL-SAMAA AL-DAOLIA FOR GENERAL TRADING AND CONTRACTING COMPANY LTD. ("EVIQ", "we", "us"). If you do not agree, do not use the service.

1. The service

EVIQ provides:

• A web portal and mobile app for finding, starting, and stopping EV charging sessions on EVIQ-managed stations.
• An in-app wallet you top up via supported payment methods (ZainCash, FIB, AsiaPay, Stripe, etc.).
• Transactional notifications about your sessions and wallet activity, on channels you choose.

2. Eligibility

You must be at least 18 years old and own or have permission to charge the vehicle you connect. You must provide accurate registration information.

3. Account responsibilities

• Keep your password and OTP codes confidential.
• Activity from your account is treated as performed by you.
• Notify us immediately at support@ev.iq if you suspect unauthorised access.

4. Charging sessions

Your wallet must hold at least the pre-authorisation amount required by the station's tariff. We freeze the pre-auth at session start and release it at session end.

• Use only chargers and connectors that match your vehicle.
• Stop the session and unplug your cable when charging is complete.
• Pay idle fees if you leave your vehicle plugged in beyond the grace period set by the station owner.
• Pay the difference if a session's actual cost exceeds the pre-authorisation.

5. Wallet, payments and refunds

• Wallet balances are not interest-bearing and are not redeemable for cash.
• Top-ups are processed by third-party payment gateways. Disputes about top-ups should be raised with the relevant gateway.
• If a session is interrupted by a fault on our side, we refund any over-charged amount to your wallet within 7 days.
• Disputed idle fees: contact billing@ev.iq within 30 days with the session ID.

6. Acceptable use

You will not:

• Use the service to charge stolen or unregistered vehicles.
• Bypass authentication, OTP verification, or wallet checks.
• Reverse-engineer, scrape, or attack our systems.
• Resell EVIQ services without a written commercial agreement.
• Use the service in violation of any applicable law.

7. Suspension and termination

We may suspend or terminate your account if we reasonably believe you have breached these Terms. We will refund your remaining wallet balance, less any disputed amounts, within 30 days of termination.

8. Disclaimers and limitation of liability

The service is provided "as is" and "as available". We do not guarantee any specific charger will be available at any specific moment. To the maximum extent permitted by law, EVIQ is not liable for indirect, incidental, or consequential damages.

9. Notifications

By providing a phone, email, or messaging-app ID, you consent to receive transactional notifications related to your account and charging activity. You can change channel preferences in Settings → Notifications, or stop WhatsApp messages by replying STOP.

10. Changes to these Terms

We may update these Terms from time to time. Material changes are communicated by email and in-app notice at least 14 days before they take effect.

11. Governing law

These Terms are governed by the laws of the Republic of Iraq. Disputes will be resolved in the courts of Erbil, Kurdistan Region, Iraq.
